1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you and esstuary fis regarding your use of our services, including financial education workshops and website. By enrolling in our workshops, accessing our website, or using our services, you agree to be bound by these terms.

If you do not agree with any part of these terms, you must not use our services.

2. Definitions

For the purposes of these Terms and Conditions:

  • "Service" refers to all workshops, educational programs, consultations, and related materials provided by esstuary fis.
  • "Participant" or "You" refers to any individual who enrolls in our workshops or uses our services.
  • "We," "Us," "Our," or "Company" refers to esstuary fis.
  • "Workshop" refers to any financial education program we offer, including but not limited to Financial Decluttering, Behavioural Budgeting, and Life-Stage Financial Architecture workshops.
  • "Content" refers to all educational materials, resources, and intellectual property provided through our services.

3. Eligibility

To enroll in our workshops and use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

We reserve the right to refuse service to anyone who does not meet these requirements or who we reasonably believe may disrupt the learning environment.

4. Workshop Enrollment and Payment

4.1 Registration

Workshop enrollment requires submission of a completed registration form and payment of applicable fees. Enrollment is confirmed only upon receipt of full payment.

4.2 Fees and Payment

  • All workshop fees are stated in Malaysian Ringgit (RM)
  • Payment must be received in full before the workshop start date
  • We accept payment via bank transfer, credit card, or other approved methods
  • Prices are subject to change, but confirmed enrollments honor the price at time of registration
  • Payment receipts will be provided for all transactions

4.3 Refund Policy

  • More than 14 days before start: Full refund minus 5% administrative fee
  • 7-14 days before start: 50% refund
  • Less than 7 days before start: No refund
  • After workshop begins: No refund for any reason

Refunds are processed within 14 business days of approval. We reserve the right to cancel workshops due to insufficient enrollment, in which case full refunds will be provided.

4.4 Transfers

You may transfer your enrollment to another scheduled workshop of the same type subject to availability, with at least 7 days notice before the original workshop start date. One transfer per enrollment is permitted at no additional charge. Subsequent transfers incur a RM 100 administrative fee.

5. Workshop Attendance and Participation

5.1 Attendance Requirements

  • Participants are expected to attend all scheduled sessions
  • Punctuality is required to avoid disrupting other participants
  • Session summaries will be provided if you must miss a session due to emergency
  • Repeated absences may result in removal from the workshop without refund

5.2 Conduct Expectations

All participants must:

  • Treat facilitators and other participants with respect
  • Maintain confidentiality regarding personal information shared by others
  • Avoid disruptive behavior during sessions
  • Refrain from recording sessions without explicit permission
  • Not use workshop time to promote personal business interests

We reserve the right to remove participants who violate these conduct expectations without refund.

6. Intellectual Property

6.1 Our Intellectual Property

All workshop content, materials, methodologies, and resources are the exclusive intellectual property of esstuary fis and are protected by Malaysian and international copyright laws. This includes but is not limited to:

  • Workshop curricula and teaching materials
  • Workbooks, templates, and frameworks
  • Recorded sessions and presentations
  • Digital resources and documentation

6.2 Limited License

Upon enrollment, you receive a limited, non-exclusive, non-transferable license to use workshop materials for your personal educational purposes only. You may not:

  • Reproduce, distribute, or publish materials without written permission
  • Use materials for commercial purposes
  • Modify or create derivative works from materials
  • Share access credentials or materials with non-participants

7. Disclaimers

7.1 Educational Purpose

Our workshops provide general financial education and are not personalized financial advice. We are not licensed financial advisors, and our content should not be construed as specific recommendations for your individual situation.

7.2 No Guarantees

We do not guarantee specific financial outcomes or results from participation in our workshops. Financial success depends on many factors beyond our control, including your personal circumstances, effort, and market conditions.

7.3 Professional Advice

Workshop content does not replace consultation with qualified financial advisors, accountants, lawyers, or other professionals. You should seek professional advice for your specific situation before making significant financial decisions.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • esstuary fis shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services
  • Our total liability for any claims related to our services is limited to the amount you paid for the specific workshop in question
  • We are not liable for financial losses resulting from decisions you make based on workshop content
  • We are not responsible for technical issues, service interruptions, or force majeure events

9. Indemnification

You agree to indemnify and hold harmless esstuary fis, its employees, facilitators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms and Conditions
  • Your violation of any rights of another party
  • Your misuse of workshop content or materials
  • Financial decisions you make based on workshop content

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which should be read in conjunction with these Terms and Conditions. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Modifications to Services and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We will make reasonable efforts to notify enrolled participants of significant changes that affect scheduled workshops.

11.2 Terms Updates

We may update these Terms and Conditions periodically. Continued use of our services after changes constitutes acceptance of updated terms. We will notify participants of material changes via email and update the "Last Updated" date above.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice, for:

  • Violation of these Terms and Conditions
  • Disruptive or inappropriate conduct
  • Fraudulent activity or payment issues
  • Any reason we deem necessary to protect our business or other participants

Upon termination, your right to access workshop materials and resources ceases immediately. Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Sarawak, Malaysia.

13.2 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us to resolve disputes informally. Many concerns can be addressed through open communication.

14. General Provisions

14.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and esstuary fis regarding our services.

14.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these terms shall not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer your rights under these terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Notices

All notices under these terms must be in writing and delivered to the contact information provided below. Email notices to you will be deemed effective when sent to the email address you provided during registration.
